In terms of the Berlin Declaration on Open Access to Knowledge in the Sciences and Humanities the aim of open access (OA) is to make scientific knowledge openly accessible to anyone free of charge while under the protection of the German Copyright. There are two possible ways to support this idea:

The Golden Road of open access refers to the first publication in open access journals or open access books.

The Green Road of open access refers to the self-archiving of digital documents simultaneously or retrospectively in an institutional or subject based repository.
The majority of publishers permit digital second publication under strict conditions. If you like to have further information about the publisher’s policies, please search the database of SHERPA/RoMEO list.

With the amendment of the German copyright (  § 38(4) UrhG ) the digital second publication is under strict conditions always possible.
